Terms of Service

1. Definitions

"Service" refers to the sardegna.delivery platform for prepared meal delivery. "User" refers to any individual or legal entity using the Service. "Subscription" means the weekly meal delivery plan subscribed to by the User.

2. Service Description

sardegna.delivery provides a chilled meal preparation and delivery service in the Olbia area and surroundings (Sardinia, Italy). Meals are prepared in a central kitchen, sealed, and delivered by dedicated couriers.

3. Registration and Account

  • An account with accurate and up-to-date information is required to use the Service
  • Users are responsible for keeping their login credentials confidential
  • Creating multiple accounts or providing false information is prohibited
  • The delivery address must be within active coverage zones

4. Subscriptions and Orders

  • Subscriptions are weekly with automatic renewal, unless configured otherwise
  • The weekly menu is published in advance. Users can customize dish selections before the weekly deadline (Thursday 18:00, Europe/Rome timezone)
  • After the deadline, unselected choices are filled with default dishes
  • Promotional orders are limited to one per User and are not available for Users with an active subscription

5. Pricing and Payments

  • Prices are listed in Euros (EUR) and include VAT where applicable
  • Payment is processed via credit/debit card (Stripe) or bank transfer (companies with 10+ subscriptions only)
  • Automatic weekly charges occur every Friday at 08:00
  • B2B clients receive progressive discounts based on total company portions
  • In case of failed payment, the system retries up to 3 times. After the third failure, the subscription is suspended

6. Pause and Cancellation

  • Users can pause their subscription for up to 4 weeks
  • Subscription cancellation is possible at any time and takes effect from the following week
  • Single order cancellation is only possible before the weekly deadline. After the deadline, a credit is issued rather than a direct refund

7. Deliveries

  • Deliveries occur on weekdays (Monday-Friday), unless the menu is configured otherwise
  • Users must ensure the delivery address is accessible during delivery hours
  • No automatic refund is provided for failed deliveries caused by the User
  • Delivery photos are taken by couriers as proof of delivery

8. Claims

  • Claims must be submitted within 24 hours of delivery
  • sardegna.delivery reserves the right to evaluate each claim and decide on refunds or credits
  • Approved refunds are processed through the original payment method

9. Allergies and Intolerances

Dishes may contain allergens. Allergen information is provided for each dish in accordance with EU regulations (14 main allergens). Users are responsible for checking dish composition in relation to their allergies. sardegna.delivery cannot guarantee the complete absence of cross-contamination.

10. Intellectual Property

All Service content (text, images, trademarks, software) is owned by sardegna.delivery and protected by copyright law. Reproduction without written authorization is prohibited.

11. Limitation of Liability

sardegna.delivery strives to provide quality service but is not liable for:

  • Delays due to force majeure (weather conditions, emergencies)
  • Temporary service interruptions for maintenance
  • Damages resulting from improper use of the Service by the User

12. Service Suspension

sardegna.delivery reserves the right to suspend or block User access in case of Terms violation, fraudulent use, or abusive behavior.

13. Changes to Terms

We reserve the right to modify these Terms. Changes will be communicated via email and published on this page. Continued use of the Service after modification constitutes acceptance of the new terms.

14. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes shall be subject to the jurisdiction of the Court of Tempio Pausania (SS), without prejudice to mandatory consumer protection provisions.
